This case is totally meritless, but somehow it made it to the highest court in the US. The Supreme Court seems to be siding with the FDA and continuing to allow access to the abortion drug mifepristone. If SCOTUS had decided to go the other way, and side with '“doctors” who are claiming injury because they personally object to abortions, this would upend the entire judicial system because everyone could bring cases of injury due to religious or personal beliefs. The Supreme Court has an easy out in this case because there was never a real injury that the plaintiffs are claiming. Not only would this affect the courts but also how the FDA regulates pharmaceuticals, which would be drastically altered if the Supreme Court ruled for a ban of mifepristone.
How could lower courts have ever ruled in favor of the anti-abortion group of doctors when they never provided proof of impact of mifepristone on their ability to provide healthcare to their patients? How could any lower court agree to a ban on the abortion drug when there was never any injury to these “doctors”?
A lot of people are surprised that conservative justices did not attack the legality of the drug or its use, but these justices understand what will happen to the entire judicial system if they did side with anti-abortion groups that brought the case before the court. Yes, the conservative justices could eliminate an entire aspect of abortion access for millions of women in the US, but the overarching issues for a ruling in favor of the anti-abortion groups case would completely overwhelm the courts.
Two of the justices did go after the FDA and the use of the abortion drug. Alito and Thomas poked at the FDA in a very childish manner that should not be present in any court let alone the highest court in the US. Attacking an agency that is simply doing its job to provide healthcare access to Americans, is crossing political lines in court when there should be no party lines drawn but these two justices used this case as an opportunity to demean the FDA.
This case should never have made it to the Supreme Court. These “doctors” have not been forced into giving abortions because of mifepristone, causing them injury. It is frivolous and a waste of the court’s time.
If these medical professionals do not want to assist in abortions, they can simply not assist in abortions. What they are trying to do in this case is to place a ban for the US on something that they personally object to but making their personal beliefs against abortion a legitimate reason for refusing women and pregnant people the access to abortion care that they need.
These “doctors” don’t prescribe mifepristone and have never even had a patient who has had complications due to the abortion drug. Yet, here we are with a case before the Supreme Court.
What is alarming is that a group could push such an oppressive and unwarranted case all the way to SCOTUS.
What is alarming is that SCOTUS is still open to diminishing access to abortion after they overturn Roe v. Wade.
As much as groups might want to think this is a win for women, it is more so that the Supreme Court does not create a massive upheaval in the judicial system and the FDA than it is for women’s rights and access to abortion. It shouldn’t be that way. The court should be protecting women first and foremost before ruling in favor of a case for other ulterior motives. Women should not be ecstatic over indirect wins. SCOTUS was not doing this out of compassion for women, but because they did not want to create a headache for the courts and the FDA.
